What is a Remote Work Agreement?

Under a remote work agreement, an employer gives employees the option to work partly or fully remotely. The employees may work from home or anywhere (for example, while on the road or in a co-working space). It is important to ensure that work-related information continues to be treated confidentially even while working outside of the usual business premises and that the quality of work is guaranteed. The employees’ obligations in this regard must therefore be carefully defined.

If the employees work remotely at their request, the additional costs incurred (for example, the cost of a laptop, a headset, an Internet connection, or electricity) must be covered by the employees. The employer must only compensate the costs incurred if they do not provide the employees with a suitable workplace. If the employer covers the costs incurred, how the employees are compensated must be regulated. In practice, a monthly lump sum is often paid.
